Terms of Service — Makers UAE

Welcome to Makers UAE ("we", "us", "our"). These Terms of Service ("Terms") govern your access to and use of the website makersuae.com (the "Site") and your purchase of any products from us. By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. About Us

Makers UAE is a UAE-based retailer specializing in 3D printers, filaments, spare parts, and related accessories and devices. From time to time we may also offer a limited range of 3D printed items and other products; all products are subject to availability and may be added or discontinued at our discretion.

2. Eligibility & Accounts

  • You must be at least 18 years old, or use the Site under the supervision of a parent or legal guardian, to place an order.
  • If you create an account, you are responsible for maintaining the confidentiality of your login details and for all activity under your account. Please notify us immediately of any unauthorized use.

3. Products & Information Accuracy

  • We make every reasonable effort to display products, specifications, and images accurately. Minor variations in color and appearance may occur due to screen settings and manufacturing batches.
  • Printer specifications, features, and software compatibility are as stated by the manufacturer and may change. Please review the manufacturer's official documentation before purchase.
  • We reserve the right to correct any errors in product descriptions or pricing, and to cancel any order affected by such an error with a full refund.

4. Pricing, VAT & Payment

  • All prices are displayed in UAE Dirhams (AED) and, where applicable, are inclusive of 5% Value Added Tax (VAT) in accordance with UAE law.
  • Prices and promotions may change at any time without notice; the price applicable to your order is the price displayed at checkout.
  • We accept the payment methods shown at checkout. Payment is processed through secure third-party payment providers; we do not store your full card details.
  • For cash-on-delivery orders (where offered), payment is due in full upon delivery.

5. Orders & Acceptance

  • Your order is an offer to purchase. An order is accepted only when we dispatch the products or confirm acceptance, whichever comes first.
  • We may refuse or cancel any order, including for suspected fraud, stock unavailability, pricing errors, or delivery-area limitations. If your payment has been taken and the order is cancelled by us, you will receive a full refund.

6. Shipping & Delivery

  • Delivery times shown on the Site are estimates and are not guaranteed. Delays caused by couriers, customs, weather, or events outside our control do not entitle the customer to compensation.
  • Risk in the products passes to you upon delivery to the address you provided. Please inspect your order upon receipt, especially printers and electronic devices, and report any visible damage within the period stated in our Refund & Return Policy.
  • You are responsible for providing an accurate delivery address and being available to receive the order. Re-delivery or return fees caused by incorrect details or failed handover may be charged to the customer.

7. Returns, Refunds & Warranty

  • Returns and refunds are governed by our Refund & Return Policy, which forms part of these Terms.
  • 3D printers and electronic devices are covered by the manufacturer's warranty in accordance with its terms. Warranty coverage does not extend to damage caused by misuse, improper assembly, unauthorized modification, third-party firmware, or normal wear of consumable parts (nozzles, build plates, belts, and similar).
  • Nothing in these Terms limits your statutory rights under UAE Federal Law No. 15 of 2020 on Consumer Protection.

8. Product Safety & Proper Use

  • 3D printers are technical devices that operate at high temperatures with moving parts. They must be assembled, operated, and maintained in accordance with the manufacturer's instructions, on a stable surface, in a ventilated area, and kept away from unsupervised children.
  • Filaments and printed parts may not be food-safe or heat-resistant unless expressly stated by the manufacturer. You are responsible for ensuring that any item you print is fit for your intended use.
  • We are not responsible for objects you design or print using products purchased from us, nor for any infringement of third-party rights arising from your own designs or files.

9. Intellectual Property

  • All content on the Site — including the Makers UAE name, logo, text, images, and layout — is owned by or licensed to us and may not be copied, reproduced, or used commercially without our prior written consent.
  • Third-party trademarks (including manufacturer brands such as Bambu Lab) belong to their respective owners. Their appearance on the Site is for product identification only and does not imply endorsement.

10. Acceptable Use

You agree not to misuse the Site, including by attempting unauthorized access, introducing malicious code, scraping content, placing fraudulent orders, or using the Site in violation of UAE law.

11. Limitation of Liability

  • To the maximum extent permitted by UAE law, our total liability for any claim arising out of an order shall not exceed the amount you paid for that order.
  • We are not liable for indirect or consequential losses, including loss of profit, loss of data, or business interruption, arising from the use of products purchased from the Site, except where liability cannot be excluded under UAE law.
  • Nothing in these Terms excludes liability for fraud or for death or personal injury caused by our negligence.

12. Force Majeure

We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, war, governmental action, strikes, or failures of couriers, suppliers, or telecommunications networks.

13. Privacy

Your personal data is processed in accordance with our Privacy Policy, which forms part of these Terms.

14. Changes to These Terms

We may update these Terms from time to time. The version published on the Site at the time you place your order applies to that order.

15. Governing Law & Jurisdiction

These Terms are governed by the laws of the United Arab Emirates and the applicable local laws of the Emirate of Dubai. Any dispute that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the courts of Dubai, without prejudice to any mandatory consumer protection provisions.

مرحبًا بكم في ميكرز الإمارات ("نحن"). تنظّم شروط الخدمة هذه ("الشروط") استخدامكم لموقع makersuae.com ("الموقع") وشراءكم لأي منتجات منّا. باستخدامكم الموقع أو تقديم أي طلب شراء، فإنكم توافقون على هذه الشروط. وإذا كنتم لا توافقون عليها، يُرجى عدم استخدام الموقع.

1. من نحن

ميكرز الإمارات متجر إماراتي متخصص في بيع الطابعات ثلاثية الأبعاد وخيوط الطباعة (الفلامنت) وقطع الغيار والإكسسوارات والأجهزة ذات الصلة. وقد نعرض من وقت لآخر تشكيلة محدودة من المنتجات المطبوعة ثلاثية الأبعاد وغيرها من المنتجات؛ وتخضع جميع المنتجات للتوفر ويجوز لنا إضافتها أو إيقافها وفق تقديرنا.

2. الأهلية والحسابات

  • يجب أن يكون عمركم 18 عامًا على الأقل لتقديم طلب شراء، أو أن يتم استخدام الموقع تحت إشراف أحد الوالدين أو الوصي القانوني.
  • في حال إنشاء حساب، فأنتم مسؤولون عن الحفاظ على سرية بيانات الدخول وعن جميع الأنشطة التي تتم من خلال حسابكم. ويُرجى إبلاغنا فورًا عن أي استخدام غير مصرح به.

3. المنتجات ودقة المعلومات

  • نبذل جهودًا معقولة لعرض المنتجات ومواصفاتها وصورها بدقة، وقد تحدث اختلافات طفيفة في الألوان والمظهر بسبب إعدادات الشاشات واختلاف دفعات التصنيع.
  • مواصفات الطابعات وخصائصها وتوافقها مع البرمجيات هي وفق ما تحدده الشركة المصنّعة وقد تتغير، لذا يُرجى مراجعة الوثائق الرسمية للشركة المصنّعة قبل الشراء.
  • نحتفظ بالحق في تصحيح أي أخطاء في أوصاف المنتجات أو أسعارها، وفي إلغاء أي طلب تأثر بمثل هذا الخطأ مع استرداد كامل المبلغ.

4. الأسعار وضريبة القيمة المضافة والدفع

  • تُعرض جميع الأسعار بالدرهم الإماراتي (AED) وتشمل، حيثما ينطبق ذلك، ضريبة القيمة المضافة بنسبة 5% وفقًا لقوانين دولة الإمارات.
  • يجوز تغيير الأسعار والعروض في أي وقت دون إشعار مسبق، ويكون السعر المطبق على طلبكم هو السعر المعروض عند إتمام الشراء.
  • نقبل وسائل الدفع الموضحة عند إتمام الشراء. وتتم معالجة المدفوعات عبر مزودي خدمات دفع آمنين من الغير، ولا نقوم بتخزين بيانات بطاقتكم الكاملة.
  • في طلبات الدفع عند الاستلام (حيثما تتوفر)، يُستحق سداد كامل المبلغ عند التسليم.

5. الطلبات وقبولها

  • يُعد طلبكم عرضًا للشراء، ولا يُعتبر الطلب مقبولًا إلا عند شحن المنتجات أو تأكيد القبول من جانبنا، أيهما أسبق.
  • يجوز لنا رفض أو إلغاء أي طلب، بما في ذلك في حالات الاشتباه بالاحتيال أو عدم توفر المخزون أو أخطاء التسعير أو قيود مناطق التوصيل. وإذا تم خصم المبلغ وألغينا الطلب، فستستردون كامل المبلغ المدفوع.

6. الشحن والتسليم

  • مدد التوصيل المعروضة على الموقع تقديرية وغير مضمونة، ولا يترتب على التأخير الناتج عن شركات التوصيل أو الجمارك أو الأحوال الجوية أو الظروف الخارجة عن إرادتنا أي حق في التعويض.
  • تنتقل مسؤولية المنتجات إليكم عند تسليمها إلى العنوان الذي قدمتموه. ويُرجى فحص طلبكم عند الاستلام، وخصوصًا الطابعات والأجهزة الإلكترونية، والإبلاغ عن أي تلف ظاهر خلال المدة المحددة في سياسة الاسترجاع والاستبدال.
  • أنتم مسؤولون عن تقديم عنوان تسليم صحيح وعن التواجد لاستلام الطلب. وقد يتحمل العميل رسوم إعادة التوصيل أو الإرجاع الناتجة عن بيانات غير صحيحة أو تعذر التسليم.

7. الاسترجاع والاسترداد والضمان

  • تخضع عمليات الاسترجاع والاسترداد لسياسة الاسترجاع والاستبدال الخاصة بنا، والتي تُعد جزءًا لا يتجزأ من هذه الشروط.
  • تخضع الطابعات ثلاثية الأبعاد والأجهزة الإلكترونية لضمان الشركة المصنّعة وفقًا لشروطه. ولا يشمل الضمان الأضرار الناتجة عن سوء الاستخدام أو التركيب الخاطئ أو التعديلات غير المصرح بها أو البرمجيات غير الرسمية أو الاستهلاك الطبيعي للقطع الاستهلاكية (كالفوهات وألواح الطباعة والأحزمة وما شابهها).
  • لا يوجد في هذه الشروط ما يحد من حقوقكم المقررة بموجب القانون الاتحادي رقم (15) لسنة 2020 في شأن حماية المستهلك.

8. سلامة المنتجات والاستخدام السليم

  • الطابعات ثلاثية الأبعاد أجهزة تقنية تعمل بدرجات حرارة مرتفعة وتحتوي على أجزاء متحركة، ويجب تجميعها وتشغيلها وصيانتها وفقًا لتعليمات الشركة المصنّعة، على سطح ثابت وفي مكان جيد التهوية، مع إبقائها بعيدًا عن متناول الأطفال دون إشراف.
  • قد لا تكون خيوط الطباعة والقطع المطبوعة آمنة للاستخدام الغذائي أو مقاومة للحرارة ما لم تُصرّح الشركة المصنّعة بذلك، وأنتم مسؤولون عن التأكد من ملاءمة أي قطعة تطبعونها للغرض المقصود منها.
  • لسنا مسؤولين عن التصاميم أو القطع التي تقومون بطباعتها باستخدام منتجات تم شراؤها منّا، ولا عن أي انتهاك لحقوق الغير ينشأ عن تصاميمكم أو ملفاتكم الخاصة.

9. الملكية الفكرية

  • جميع محتويات الموقع — بما في ذلك اسم وشعار ميكرز الإمارات والنصوص والصور والتصميم — مملوكة لنا أو مرخّصة لنا، ولا يجوز نسخها أو إعادة إنتاجها أو استخدامها تجاريًا دون موافقة كتابية مسبقة منّا.
  • العلامات التجارية العائدة للغير (بما فيها علامات الشركات المصنّعة مثل Bambu Lab) مملوكة لأصحابها، وظهورها على الموقع هو لغرض تعريف المنتجات فقط ولا يعني أي رعاية أو تبنٍّ.

10. الاستخدام المقبول

توافقون على عدم إساءة استخدام الموقع، بما في ذلك محاولة الوصول غير المصرح به، أو إدخال برمجيات ضارة، أو نسخ المحتوى آليًا، أو تقديم طلبات احتيالية، أو استخدام الموقع بما يخالف قوانين دولة الإمارات.

11. حدود المسؤولية

  • إلى الحد الأقصى الذي تسمح به قوانين دولة الإمارات، لا تتجاوز مسؤوليتنا الإجمالية عن أي مطالبة ناشئة عن أي طلب قيمة المبلغ المدفوع عن ذلك الطلب.
  • لسنا مسؤولين عن الخسائر غير المباشرة أو التبعية، بما في ذلك خسارة الأرباح أو فقدان البيانات أو توقف الأعمال، الناشئة عن استخدام المنتجات المشتراة من الموقع، إلا فيما لا يجوز استبعاده قانونًا.
  • لا يوجد في هذه الشروط ما يستبعد المسؤولية عن الاحتيال أو عن الوفاة أو الإصابة الجسدية الناتجة عن إهمالنا.

12. القوة القاهرة

لسنا مسؤولين عن أي تأخير أو إخفاق في التنفيذ ناتج عن ظروف خارجة عن سيطرتنا المعقولة، بما في ذلك الكوارث الطبيعية أو الحروب أو الإجراءات الحكومية أو الإضرابات أو تعطل شركات التوصيل أو الموردين أو شبكات الاتصالات.

13. الخصوصية

تُعالج بياناتكم الشخصية وفقًا لسياسة الخصوصية الخاصة بنا، والتي تُعد جزءًا من هذه الشروط.

14. تعديل الشروط

يجوز لنا تحديث هذه الشروط من وقت لآخر، وتسري على طلبكم النسخة المنشورة على الموقع وقت تقديم الطلب.

15. القانون الواجب التطبيق والاختصاص القضائي

تخضع هذه الشروط لقوانين دولة الإمارات العربية المتحدة والتشريعات المحلية المعمول بها في إمارة دبي. وأي نزاع يتعذر حله وديًا يخضع للاختصاص الحصري لمحاكم دبي، وذلك دون الإخلال بأي أحكام إلزامية لحماية المستهلك.
